GENERAL CONDITIONS OF DISTANCE SELLING
ARTICLE 1 - DEFINITION
1.1 "GCS" refers to the present General Terms and Conditions of Sale which govern all distance selling between JERYCAN AND PARTNERS and the CUSTOMER. They apply exclusively to the online sale of products listed on the https://cbddiscount.co.uk/ website, which is freely accessibl/e to all Internet users.
1.3 "CLIENT" refers to any natural person of legal age or legal entity requesting the services of the SERVICE SUPPLIER. The person or company signing these GTS (signature) guarantees payment of the invoice, even if it is drawn up in the name of a third party.
1.4 The JERYCAN AND PARTNERS website https://cbddiscount.co.uk/ where these GTCS are presented is hereinafter referred to as the "WEBSITE".
1.5 "PRODUCT" is any item whose commercialization is managed by JERYCAN AND PARTNERS.

ARTICLE 2 - ENFORCEABILITY OF THE CGV
2.1 The General Terms and Conditions of Sale govern exclusively the online sale of JERYCAN AND PARTNERS products to customers and, together with the online order, constitute the contractual documents binding on the parties, to the exclusion of any other document, prospectus, catalog or photograph of the products, which are for information purposes only.
2.2 The GCS apply exclusively to products delivered to customers located in mainland France, the French overseas territories and/or EU member states, with the exception of the Fleur de CBD for France.
2.3 The GCS, as well as all contractual information mentioned on the site, are written in the French language.
2.4 The GCS are made available to consumers on the seller's website, where they can be consulted directly.
2.5 The terms and conditions of sale are binding on the customer, who acknowledges having read and accepted them before validating the order by checking a box provided for this purpose.
The validation of the order by its confirmation implies acceptance by the customer of the GCS in force on the day of the order, the conservation and reproduction of which are ensured by the professional seller in accordance witharticle 1127-2 of the French Civil Code.
2.6 JERYCAN AND PARTNERS reserves the right to modify its GCS at any time. In the event of modification of the GTC, the applicable GTC are those in force at the date of the order, a copy of which dated to that date may be provided at the customer's request.
2.7 The nullity of a contractual clause does not entail the nullity of the GCS, unless it is an impulsive and determining clause which led one of the parties to conclude the sales contract. The temporary or permanent non-application of one or more clauses of the GTCS by JERYCAN AND PARTNERS does not constitute a waiver of the other clauses of the GTCS, which continue to be effective.
ARTICLE 3 - PRODUCTS
3.1 The products offered for sale in the catalog published on the site are each described in terms of their essential characteristics as defined inarticle L. 111-1 of the French Consumer Code. The method of use of the product, if this is an essential element, is mentioned in the electronic catalog or at the latest on delivery.
3.2 The photographs illustrating the products do not constitute a contractual document.
3.3 Products are offered and delivered while stocks last.
3.4 The Customer may obtain a detailed description of each product offered for sale by "JERYCAN AND PARTNERS" on the Website by clicking on the product. Pursuant to Article L. 111-1 of the French Consumer Code, the Customer may take note of the essential characteristics of the products he/she wishes to purchase before placing an order. Product descriptions are written in French. The Customer may also contact customer service by telephone for any queries concerning the products.
3.5 Products offered for sale on the Website are subject to availability by " JERYCAN AND PARTNERS ".
3.6 " JERYCAN AND PARTNERS " reserves the right to modify the catalog of products offered for sale on its Website. Orders placed by the customer before the modifications will be honored.
3.7 The products sold on the website comply with Swiss legislation in force at the time of sale.
Article L. 111-1 of the French Consumer Code states that, in the event that we inform consumers of any risks associated with our products, we shall not be held responsible for any consequences that may arise.
ARTICLE 4 - PRICES
4.1 Sale prices are indicated, for each of the products listed in the electronic catalog, in euros including all taxes, but excluding delivery and transport costs.
4.2 The selling price of the product is that in force on the day the order is placed.
4.3 Delivery and transport costs are mentioned before the order is validated and are invoiced in addition, except when the order exceeds a sum previously announced on the "Delivery and payment" page of the WEBSITE.
4.4 In the event of a price promotion, JERYCAN AND PARTNERS undertakes to apply the promotional price to all orders placed during the promotional advertising period.
4.5 JERYCAN AND PARTNERS reserves the right to modify its prices at any time, while guaranteeing the customer the application of the price in effect on the day of the order.
4.6 Delivery to French overseas departments and territories is not available.
ARTICLE 5 - OFFERS
5.1 The online sales offers presented on the WEBSITE are reserved for CUSTOMERS residing in France / overseas territories and/or in a member state of the European Union and for deliveries in these same geographical areas.
5.2 The online sales offers presented on the WEBSITE are valid for as long as the products appear in the electronic catalog and within the limits of available stocks, unless otherwise indicated.
5.3 Acceptance of the offer by the CLIENT is validated, in accordance with the double-click procedure, by confirmation of the order.
ARTICLE 6 - CUSTOMER ACCOUNT
Before placing an order on the site, the Customer may create a customer account. To this end, he/she must fill in a form in the "My Account" section with information concerning him/herself, and undertakes to provide accurate information and not to usurp the identity of a third party or modify his/her age.
In particular, the Customer provides an e-mail address and a password, which will be used to identify him/herself on the site at a later date. The login and password are personal and the Customer undertakes not to divulge them.
ARTICLE 7 - ORDERING
7.1 Access to sales made via the Internet Site is reserved exclusively for Customers who have reached the age of 18 and who have the capacity to enter into sales contracts.
6.2 Under no circumstances may resellers or wholesalers or, in general, all parties intending to purchase Products for subsequent resale, make purchases on the Site. Such persons are therefore prohibited from registering on the Site and making purchases on the Site.
7. 1. Steps involved in concluding the contract: To place an order, the customer fills his or her virtual shopping cart with the products selected and the quantities required, then clicks on the "Order" button and provides information on delivery and payment.
Before clicking on the "Order" button, the customer can check the details of his order and its total price, and return to the previous pages to correct any errors or modify his order.
The sales contract is formed when the customer sends confirmation of his/her order.
7.2. Order modification: Any order modification by the customer after order confirmation is subject to acceptance by the professional seller.
7.3. Order confirmation: JERYCAN AND PARTNERS will send an email confirming receipt of the order and payment as soon as possible.
JERYCAN AND PARTNERS reserves the right to refuse any order for legitimate reasons, particularly if the quantity of products ordered is abnormally high for private customers. JERYCAN AND PARTNERS reserves the right to refuse or cancel orders from a Customer with whom it has an ongoing legal dispute; from a Customer who has previously violated these General Terms and Conditions of Sale and / or the conditions and / or terms of a purchase agreement with "JERYCAN AND PARTNERS"; from a Customer who has been involved in fraud of any kind and, in particular, in fraud related to credit card payments.
7.4. Archiving: Communications, order forms and invoices are archived on a reliable and durable medium so as to constitute a true and durable copy in accordance with article 1360 of the French Civil Code. These communications, order forms and invoices may be produced as proof of the contract.
ARTICLE 8- PAYMENT
The price of the Products is payable in full once the order has been confirmed.
8.1 All Product prices are quoted in Euros (€) and include Value Added Tax ("VAT") in accordance with article L. 112-1 of the French Consumer Code. Shipping costs and any other additional costs, including VAT and expressed in Euro (€), will be indicated separately on the order form, before the customer transmits the order.
8.2 The price of Products may be modified by "JERYCAN AND PARTNERS" at any time, without prior notice, it being understood that the price invoiced to the Customer will be that published on the information sheet illustrating the main characteristics of the Product ("Product Sheet") at the time the order is sent.
Any modification (upwards or downwards) of the price subsequent to the transmission of the order will not be taken into account.
8.3 Payment for Products may be made by credit card or using the WeldPay and Vivawallet services. In the event that one of these payment methods / solutions cannot be used in relation to a specific Product, this will be clearly indicated on the Site, at the latest at the start of the purchase procedure.
8.4 Payment receipts will be issued automatically for each purchase. For the first purchase, the Customer will be asked to provide the header data of the receipt. For the issuance of the receipt, the information provided for this purpose by the Customer, which he declares and guarantees to be true, undertaking to keep "JERYCAN AND PARTNERS" covered and indemnified from any damages, including penalties pronounced by the competent authorities, which may arise in the event of non-compliance with the truth.
8.5 Payment security: Our site is subject to security systems.
8.6 Non-payment: In the event of non-payment of the full price within ten days, the contract will be considered automatically terminated.
ARTICLE 9 - DELIVERY
9.1 Delivery of the products ordered will take place after payment of the order, to the address provided by the Customer. To this end, the Customer must provide "JERYCAN AND PARTNERS" with a valid and accurate delivery address.
9.2. Delivery times: JERYCAN AND PARTNERS undertakes to deliver the products within the time indicated on the order validation page by the Customer, i.e. :
Your order will be prepared and shipped within 24 to 48 hours depending on the delivery method you have chosen.
Delivery times do not apply in the event of force majeure or unforeseen circumstances.
9.3 Delivery charges
Delivery charges are payable by the customer, except when the order exceeds a pre-determined amount based on the price list available on the cbddiscount.co.uk website. Delivery terms will be specifically indicated during the purchase procedure and in the order summary, and in all cases before the Customer sends the order. They will also be indicated in the order confirmation.
9.4 Delivery terms: Products are delivered to the address indicated by the customer on the order form.
All products available on the site are sent from France (except for special requests). They can be shipped to Switzerland, Metropolitan France except CBD flower, (including Corsica and Monaco) as well as to French overseas departments and territories and to the whole of Europe. This includes Belgium, Switzerland and Luxembourg.
9.5 Conformity of products: The delivery obligation is fulfilled by transferring the availability of the material to the user.
It is the Customer's responsibility to check the condition of the Product delivered / collected. The Customer is invited to check the number of Products received and that the packaging is intact, undamaged or in any way altered, and is invited, in his interest, to report any anomaly on the carrier's transport document.
Since the post office is not a leader, it cannot guarantee correct receipt of parcels. Private companies now have access to mailboxes. In this respect, JERYCAN AND PARTNERS cannot be held responsible for the safe receipt of your parcel in the event of loss or theft.
9.6 Responsibility for loss or damage to products is transferred when the Customer or the recipient of the order takes physical possession of the delivery.
9.7 The Customer represents and warrants that by failing to comply with the steps described in the preceding article, the Customer forfeits the right to reimbursement or rescheduled delivery of the products, without prejudice to the right of withdrawal under the terms and conditions described in article 10 of the general terms and conditions of sale.
9.8. Late delivery: If delivery is not made within 30 days of the date of the online order, the customer may request a refund within 30 days. This period does not apply in cases of force majeure.
9.9 Failure to deliver: Total failure to deliver will result in automatic termination of the sales contract and reimbursement of the price paid, including delivery charges. A delivery incident will not be considered as a delivery default.
ARTICLE 10 - LEGAL WARRANTY OF CONFORMITY AND WARRANTY AGAINST HIDDEN DEFECTS
All products supplied by JERYCAN AND PARTNERS are covered by the legal warranty of conformity stipulated in articles L. 217-4 et seq. of the French Consumer Code, or by the warranty against hidden defects stipulated in articles 1641 et seq. of the French Civil Code.
The French law applicable to the contract cannot have the effect of depriving the customer residing in another Member State of the provisions on guarantees granted by its national law in application of the Directive of May 25, 1999 concerning the sale of consumer goods and associated guarantees.
JERYCAN AND PARTNERS is liable for any hidden defects in the goods sold, which render them unfit for their intended use, or which impair this use to such an extent that the customer would not have purchased them, or would have paid a lower price for them, had he or she been aware of them.
The customer may decide to invoke the warranty against hidden defects in the item sold, as defined in article 1641 of the French Civil Code. In this case, the customer may choose between rescinding the sale or reducing the purchase price in accordance with article 1644 of the French Civil Code.
ARTICLE 11 - RIGHT OF WITHDRAWAL AND RETURN OF ORDERED ITEMS
In accordance with articles L. 221-5 et seq. of the French Consumer Code, the customer has a period of 14 days from receipt, by himself or a third party, of the items ordered to exercise his right of withdrawal without having to justify his decision or pay any penalties.
To exercise his right of withdrawal in relation to an Order, the Customer must inform "JERYCAN AND PARTNERS" of his decision to withdraw, before the expiration of the Withdrawal Period. All you have to do is write an e-mail or fill in the withdrawal form. Send back your entire order or the items you wish to return, and as soon as we receive it, we will refund your order.
Returned products must be new, unused and, if applicable, in their original box. Any item returned used and/or damaged by the customer will not be accepted.
Returns will only be accepted after GROW QUALITY SA has received and confirmed the claim.
It is the customer's responsibility to provide proof of return.
The Customer will be reimbursed for the full amount of the order, at the invoiced price, excluding delivery charges, within 15 days of receipt by JERYCAN AND PARTNERS of the returned order. This refund will be made by the same means of payment used for the initial transaction.
If the return is refused by JERYCAN AND PARTNERS for the above-mentioned reasons, the products will then be returned to the customer at the latter's expense without the latter being able to claim any compensation or right to reimbursement, with the exception of the subsequent exercise of its warranty rights on the products sold.
ARTICLE 12 - COMPLAINTS

ARTICLE 13 - INTELLECTUAL PROPERTY
The content of the cbddiscount.co.uk website, including the general structure, software, texts, images (animated or not), photographs, know-how and all other elements making up the site are the exclusive property of JERYCAN AND PARTNERS or its partners who have granted a license.
Any total or partial representation of this site by any person whatsoever without the express authorization of JERYCAN AND PARTNERS is prohibited and constitutes an infringement punishable by the Intellectual Property Code.
The distinctive signs of JERYCAN AND PARTNERS and its partners, such as domain names, brands, names and logos appearing on the site are protected by the Intellectual Property Code.
Any total or partial reproduction of these distinctive signs from the elements of the site without the express authorization of JERYCAN AND PARTNERS is therefore prohibited.
ARTICLE 14 - FORCE MAJEURE
The total or partial performance by "Just Bob" of its obligations will be suspended in the event of an unforeseen event or force majeure, in accordance with article 1218 of the French Civil Code, likely to invalidate or delay performance.
In the event of force majeure as defined by current case law, the performance of JERYCAN AND PARTNERS' services will be suspended in whole or in part. Force majeure is defined as any external, unforeseeable and insurmountable event preventing JERYCAN AND PARTNERS from fulfilling its contractual obligations.
In case of an event qualified as force majeure according to the previous paragraph, JERYCAN AND PARTNERS undertakes to notify the customer as soon as possible.
ARTICLE 15 - APPLICABLE LAW
This contract and the GTC governing it are governed by French law, subject to the mandatory rules of the consumer's country of residence.
In the absence of amicable agreement, any dispute relating to the existence, interpretation, conclusion, performance or breach of the contract, as well as to all documents connected with this contract, will fall within the jurisdiction of the Swiss judicial court and/or commercial court.
