Order validation by the Customer

By viewing their basket, the Customer may check the number and nature of the selected Products and verify the unit price and total price. They may remove one or more Products from their basket.
If satisfied, the Customer may validate the order. Payment methods
The Customer may pay by bank card (Visa, MasterCard, etc.) or bank transfer.
All transactions are secured via an encryption protocol.
Purchases made on this website constitute a sales contract with CALIE SASU.
Retention of title
Products sold remain the property of https://cbddiscount.co.uk/ until full payment of their price, including principal, costs, taxes, and mandatory contributions, in accordance with this retention of title clause.
ARTICLE 9 – DELIVERY
Delivery charges
As part of the ordering process, the Customer will be able to choose between several delivery methods. Delivery charges will vary depending on the delivery method, parcel weight, and destination, and these prices will appear before final confirmation of the Order.
Delivery or collection charges will, in any event, be indicated to the Customer prior to any payment and concern only deliveries made in France and Europe.

Delivery times
Subject to item availability, we aim to dispatch all orders from our warehouse within 24 to 48 hours.

Split deliveries
Where possible, https://cbddiscount.co.uk/ will always try to deliver all ordered Products in a single parcel. However, https://cbddiscount.co.uk/ is entitled to make split deliveries so that the Customer receives the Products as quickly as possible. There is no additional cost associated with such partial deliveries.
In the event of total or partial unavailability of products after the Order is placed, https://cbddiscount.co.uk/ will inform the Customer as soon as possible by email of the product’s unavailability and the total or partial cancellation of the Order.
Damaged parcel
The Customer, or the recipient of the Order, is invited to check the apparent condition of the parcel and products upon delivery.
In the event of delivery of a parcel that is clearly and visibly damaged, it is the Customer’s responsibility to refuse it in order to benefit from the carrier’s guarantee. The Customer must refuse delivery and immediately note on the carrier’s delivery slip any reservations concerning the anomaly detected, in a clear and detailed manner.
If the delivery person is not present, the damaged parcel must not be opened by the Customer or the recipient. It must be sent back to https://cbddiscount.co.uk/ within five (5) working days from delivery. In such a case, the delivery times indicated above in these general terms will no longer apply.
The Customer must also inform https://cbddiscount.co.uk/’s customer service without delay via the contact form so that a new parcel can be prepared. Incident notifications and reservations must be made promptly and at the latest within 3 working days from the delivery date.
ARTICLE 10 – CONSUMER RIGHTS
Right of withdrawal – Distance selling
We hope you will be satisfied with the Products purchased on our Site.
Without prejudice to the legal right of withdrawal available to the Customer (in accordance with Article L. 221-18 of the French Consumer Code), the Customer may exercise their right of withdrawal and return any product purchased on our Site, for any reason, within fourteen (14) days following receipt. https://cbddiscount.co.uk/ will refund the Customer the price of the relevant product(s), provided they have not been unsealed after delivery where applicable, and provided they are returned in a condition suitable for resale.
When the right of withdrawal is exercised, the professional must refund the Customer all sums paid as soon as possible and no later than fourteen (14) days from the date it is informed of the consumer’s decision to withdraw. Beyond that period, the amount due will automatically accrue interest at the applicable statutory rate. The refund will be made using the same payment method used for the initial transaction, unless the consumer expressly agrees otherwise.

If you return the parcel using your own carrier, we recommend using a tracked postal service; we are not responsible for returns until they are in our possession. It is recalled that, in accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for Orders concerning:
- goods that have been unsealed after delivery and cannot be returned for hygiene or health protection reasons,
- goods made to the Customer’s specifications or clearly personalized.
If the Customer notifies https://cbddiscount.co.uk/ of their intention to withdraw before having received the parcel corresponding to the validated order, and if https://cbddiscount.co.uk/ is not able to stop shipment, the Customer undertakes to return the relevant products within a maximum of fourteen (14) days from receipt of the Product(s), in accordance with Article L.221-23 of the French Consumer Code.
Products must be returned in a condition suitable for resale (products in perfect condition accompanied by their original packaging, accessories, instructions, etc.). Products must also be accompanied by the Order number. The Customer’s liability may be engaged in the event of depreciation of the product resulting from handling other than what is necessary to establish the nature, characteristics, and, where applicable, proper functioning of the products.
Termination of the contract at the Customer’s initiative
The Customer may terminate the contract concluded with https://cbddiscount.co.uk/ by registered letter with acknowledgement of receipt in the event the delivery date of the Product or performance of the service exceeds thirty days, after sending a formal notice to https://cbddiscount.co.uk/’s Customer Service to deliver within a reasonable additional period that remains without effect. This cancellation request must be sent by email to: support@cbddiscount.co.uk.
The Customer will then be refunded the amounts incurred at the time of ordering, as soon as possible and no later than fourteen (14) days following the date on which the Customer exercised their right to obtain cancellation of the Order.
This clause does not apply if the delivery delay is due to force majeure, in accordance with the provisions of Article 13.
Termination of the contract at https://cbddiscount.co.uk/’s initiative
In the event the Customer breaches any provision of these GTC, and in particular in the event of non-payment, partial payment, payment incidents, or fraud or attempted fraud relating to use of the Site, https://cbddiscount.co.uk/ may terminate the contract and suspend or cancel any performance of an Order and/or delivery, whatever its nature and level of performance, automatically and without court intervention.
We may reject, limit, or decline an order where your account or purchase history shows a high volume of returns and we have reasonable grounds to believe you intend to resell the items.
Termination of the contract due to the Customer’s fault is without prejudice to any damages that https://cbddiscount.co.uk/ may claim as a result of the Customer’s breach.
ARTICLE 11 – WARRANTIES
The Customer benefits from the legal warranty of conformity, arising from Articles L. 217-4 et seq. of the French Consumer Code, and the warranty against hidden defects, arising from Articles 1641 et seq. of the French Civil Code.
Legal warranty of conformity
In accordance with applicable provisions:
Article L.217-4 of the French Consumer Code: “The seller delivers goods in conformity with the contract and is liable for defects in conformity existing at the time of delivery. The seller is also liable for defects in conformity resulting from packaging, assembly instructions or installation when the latter was made the seller’s responsibility by the contract or was carried out under the seller’s responsibility.”
Article L.217-5 of the French Consumer Code: “Goods conform to the contract: 1° If they are fit for the use usually expected of similar goods and, where applicable: - if they correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model; - if they possess the qualities that a buyer may legitimately expect in view of the public statements made by the seller, the producer or its representative, particularly in advertising or labeling; 2° Or if they present the characteristics defined by mutual agreement between the parties or are fit for any special use sought by the buyer, brought to the seller’s attention and accepted by the seller.”
Article L.217-12 of the French Consumer Code: “An action resulting from a lack of conformity is time-barred after two years from delivery of the goods.”
Legal warranty against hidden defects
In accordance with the provisions of the French Civil Code:
Article 1641 of the French Civil Code: “The seller is bound by the warranty on account of hidden defects in the thing sold which render it unfit for the use for which it is intended, or which so diminish that use that the buyer would not have acquired it, or would have paid a lower price, had they known of them.”
Article 1648 of the French Civil Code: “An action resulting from redhibitory defects must be brought by the buyer within two years from discovery of the defect. In the case provided for in Article 1642-1, the action must be brought, on pain of being time-barred, within one year following the date on which the seller can be discharged from apparent defects or lack of conformity.”
Implementation of legal warranties
When acting under the legal warranty of conformity, the Customer:
- benefits from a period of two (2) years to act, from delivery of the goods;
- may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L217-9 of the French Consumer Code;
- is not required to prove the existence of the lack of conformity within the two years following delivery.
The legal warranty of conformity applies independently of any commercial warranty that may be granted.
The Customer may decide to implement the warranty against hidden defects within the meaning of Article 1641 of the French Civil Code. In this case, the Customer may choose between cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the French Civil Code.
These provisions are without prejudice to the right of withdrawal defined in Article 10 above.
ARTICLE 12 – PERSONAL ACCOUNT AREA
Creation of the personal area
Creating a personal area is an essential prerequisite for any Customer order on the Site. For this purpose, the Customer will be asked to provide a certain amount of personal information. Some of this information is considered essential for creating the personal area. The Customer’s refusal to provide such information will prevent creation of the personal area and, consequently, validation of the order.
When creating the personal area, the Customer is invited to choose a password. This password guarantees the confidentiality of the information contained in the personal area. The Customer therefore undertakes not to disclose or communicate it to any third party. Content of the personal area

Deletion of the personal area
https://cbddiscount.co.uk/ reserves the right to delete the account of any Customer who breaches these general terms, in particular where the Customer provides inaccurate, incomplete, misleading, or fraudulent information, and where a Customer’s personal area has been inactive for at least one year. Such deletion shall not constitute a fault by https://cbddiscount.co.uk/ or damage to the excluded Customer, who may not claim any compensation on this basis.
This exclusion is without prejudice to https://cbddiscount.co.uk/’s right to initiate legal proceedings against the Customer where justified.
ARTICLE 13 – LIABILITY OF https://cbddiscount.co.uk/
Nature of https://cbddiscount.co.uk/’s obligations
https://cbddiscount.co.uk/ undertakes to exercise the necessary care and diligence to provide quality Products in accordance with these general terms. https://cbddiscount.co.uk/ is only bound by an obligation of means regarding the services covered by these terms.
Force majeure – Customer’s fault
https://cbddiscount.co.uk/ shall not be liable in the event of force majeure or Customer fault, where non-performance of its obligations is attributable to the act of a third party even if foreseeable, or to any other event not reasonably under the exclusive control of https://cbddiscount.co.uk/.
Force majeure
For the purposes of these terms, any impediment, limitation, or disruption of the Site due to fire, epidemic, explosion, earthquake, bandwidth fluctuations, failure attributable to the internet service provider, failure of transmission networks, collapse of facilities, unlawful or fraudulent use of passwords, codes or references provided to the Customer, hacking, a security breach attributable to the Site host or developers, flooding, power failure, war, embargo, law, injunction, request or requirement of any government, requisition, strike, boycott, or other circumstances beyond the reasonable control of https://cbddiscount.co.uk/ shall be considered a force majeure event enforceable against the Customer. In such circumstances, https://cbddiscount.co.uk/ shall be released from performance of its obligations to the extent of such impediment, limitation, or disruption.
Customer’s fault
For the purposes of these terms, any misuse of the Site, fault, negligence, omission, or failure on the part of the Customer or their agents, failure to comply with advice given by https://cbddiscount.co.uk/ on its Site, any disclosure or unlawful use of the Customer’s password, codes and references, as well as providing incorrect information or failing to update such information in the personal area, shall be considered a Customer fault enforceable against them. The use of any technical process such as robots or automated queries that contravenes the letter or spirit of these GTC will also be considered a Customer fault.
Damages payable by https://cbddiscount.co.uk/
In the absence of contrary legal or regulatory provisions, the liability of https://cbddiscount.co.uk/ is limited to the direct, personal, and certain loss suffered by the Customer and linked to the relevant failure.

ARTICLE 14 – GENERAL PROVISIONS
Governing law

Amendments to these general terms

Entire agreement
If one or more provisions of these GTC are held or declared invalid, the other provisions shall remain in full force and effect and shall not be affected. In such a case, the parties shall, where possible, replace the invalid provision with a valid provision corresponding to the spirit and purpose of these terms.
No waiver
The fact that one of the parties does not exercise, at any time, a right granted to it under these GTC, or rights granted under these GTC to the Parties, shall in no case be interpreted as a modification of the contract or as an express or implied waiver of the right to assert such rights in the future, or the right to require performance of the undertakings set out herein.
